LERUE RUMPH v. EQUIFAX INFORMATION SERVICES, LLC et al.
ORDER
Britt Jason Rossiter, counsel for defendant MG Credit, Inc., filed an unopposed motion to withdraw as counsel. Dkt. 37. The motion will be denied without prejudice.
An attorney may withdraw from representation only “upon leave of the court and a showing of good cause and reasonable notice to the client.” In re Wynn, 889 F.2d 644, 646 (5th Cir. 1989). Good cause exists for Rossiter's withdrawal, but he has not shown that he gave reasonable notice to the client of his intent to withdraw. Instead, his motion states that he has had no contact with MG Credit “at all for months” and does not explain what attempts he made to contact MG Credit to discuss his intended withdrawal. Dkt. 37 at 3.
It is ORDERED that the motion to withdraw, Dkt. 37, is DENIED without prejudice to refiling.
