UNITED STATES OF AMERICA v. HERMAN SYLVESTER WILLIAMS
ORDER
On April 8, 2025, the Government moved to dismiss all charges against the Defendant. Within hours, the Court granted this request and ordered the Defendant released. However, the Defendant was not released due to a warrant issued by the U.S. Parole Commission.
On April 9, 2025, the Court entered a Show Cause Order directing the U.S. Parole Commission and Court Services and Offender Supervision Agency (CSOSA) authorities to appear before the undersigned to explain why their warrant—which was entirely predicated upon the dismissed federal case—was still active. In response, the U.S. Parole Commission advised it was reviewing the facts of the dismissed case. Initially, this review was set to take several days, during which time the Defendant would remain incarcerated. However, the U.S. Parole Commission expedited their review.
On April 10, 2025, the U.S. Parole Commission quashed its warrant and agreed to the release of the Defendant. Nearly 40 hours after the Court's original order, the Defendant was released from the D.C. jail. This resolves the Show Cause Order. But the greater question of why it takes moving heaven and earth to ensure a person who is ordered to be released is actually released—in a timely manner—remains unanswered.
