ORDER
It is ORDERED, on the court's own motion, that the parties submit supplemental briefs addressing the impact of Arbaugh v. F & H. Corp, 126 S. Ct. 1235, 1245 (2006), on Young v. Washington Gas Light Co., 206 F.3d 1200 (D.C. Cir. 2000), with regard to the issues raised in this case, most importantly whether the existence of an ERISA-governed plan is a requirement for federal court jurisdiction over ERISA claims. The supplemental briefs shall not exceed ten pages and shall be submitted by 5:00pm on April 12, 2006.
