ORDER
AND NOW, this 20th day of April, 2026, for the reasons set forth in the Memorandum Opinion entered on this date, it is hereby ORDERED, ADJUDGED, and DECREED that:
1. Defendant Houston Industrial Corporation's Motion to Dismiss Amended Complaint (Doc. No. 138), Defendant Amari Painting and Lining, LLC's Motion to Dismiss Amended Complaint (Doc. No. 139), Defendant Nicholas Semanderes’ Motion to Dismiss Amended Complaint (Doc. No. 140), and Defendant Geronimo Painting Co., Inc.’s Motion to Dismiss Amended Complaint (Doc. No. 141) are GRANTED IN PART AND DENIED IN PART.
2. Counts II and III of the Amended Complaint (Doc. No. 132) are DISMISSED without prejudice.
3. The Amended Complaint shall otherwise proceed as to Counts I, IV, and V.
4. Further scheduling will be addressed by a separate order.
