For the reasons stated in my dissent in United States v. Jackson, No. 22-2870, ––– F.4th ––––, 2024 WL 4683965 (8th Cir. Nov. ––––, 2024) (Stras, J., dissenting from denial of reh'g en banc), I would grant rehearing here too.
Judge Erickson, Judge Grasz, Judge Stras, and Judge Kobes would grant the petition for rehearing en banc. Judge Kelly did not participate in the consideration or decision of this matter.
