IN RE: Kristina M. JOHNSON, TRUSTEE FOR COMMUNITY HOME FINANCIAL SERVICES CORPORATION, Petitioner
This matter has been pending before the district court for over two years. That is too long of a delay. We therefore advise Judge Carlton Reeves to rule on this case within 60 days. Because we are confident that he will heed our advisement, we need not grant mandamus or reassign the case.
In his response to the mandamus petition, Judge Reeves explained that this case is “number three in the queue” and that he would take no action until the mandate issues. We are issuing the mandate forthwith.
IT IS ORDERED that the petition for writ of mandamus is DENIED WITHOUT PREJUDICE. This panel will retain jurisdiction over the decision whether to grant any subsequent petition for writ of mandamus should the district court fail to rule within 60 days. See In re Gee, 941 F.3d 153, 173 (5th Cir. 2019).
