MCCOY v. HARMON FNU FNU SIS (2018)

Christopher H. McCoy, federal prisoner # 09150-025, moves this court to proceed in forma pauperis (IFP) and for the appointment of counsel on appeal from the district court's interlocutory order denying his motion for a default judgment against the defendants named in this pending civil rights case. By moving to proceed IFP, McCoy challenges the district court's certification that his appeal is not taken in good faith. See Baugh v. Taylor, 117 F.3d 197, 202 (5th Cir. 1997). As we do not have jurisdiction to review the interlocutory order denying McCoy's motion for default judgment, see Adult Film Ass'n of America, Inc. v. Thetford, 776 F.2d 113, 115 (5th Cir. 1985), his appeal is DISMISSED FOR LACK OF JURISDICTION. His motions to proceed IFP on appeal and for the appointment of counsel are DENIED.
