Justice Devine did not participate in the decision.
Today the Court granted relief in In re Morris, No. 24-0007, ––– S.W.3d ––––, 2024 WL 109090 (Tex. 2024), holding that a primary election official has no discretion to remove a candidate from the ballot for failure to comply with Election Code Section 141.0311. For the same reason, the Court denies the requested relief in the present case.
