Michael KLEINMAN, Appellant v. The STATE of Texas
OPINION
Appellant was charged with misdemeanor offenses in municipal court. He pled no contest and the municipal court entered judgments. Appellant appealed the convictions for a trial de novo in the trial court. The trial court dismissed the appeals upon concluding that defects in the appeal bonds rendered the court without jurisdiction and that the time for amending the bonds had expired. The Third Court of Appeals held that the timely-filed bonds had perfected the appeals and that the trial court had jurisdiction to give appellant the opportunity to cure the defects and refile the bonds. Kleinman v. State, 703 S.W.3d 813 (Tex. App.–Austin 2024). The court reversed and remanded.
We granted the State's petitions for discretionary review on October 23, 2024, and the cases were submitted on March 19, 2025. The State has now filed an agreed motion to dismiss which states that the parties have reached a settlement and have agreed to dismiss the instant cases. We therefore grant the State's motion, dismiss these petitions for discretionary review, and remand the causes to the court of appeals to issue its mandate. Tex. R. App. P. 18.1.
