MEMORANDUM OPINION
Before the Court is appellant's December 6, 2017 motion to dismiss the appeal. Appellant explains that the parties have settled the underlying case. We grant appellant's motion and dismiss the appeal. See TEX. R. APP. P. 42.1(a)(1).

In accordance with this Court's opinion of this date, the appeal is DISMISSED.
It is ORDERED that appellee the State of Texas, ex rel. Kaufman County, Texas recover its costs of this appeal from appellant City of Mesquite, Texas.
