IN RE: CATALON APARTMENTS, Relator
MEMORANDUM OPINION
On March 17, 2017, relator Catalon Apartments filed a petition for writ of mandamus in this Court. See Tex. Gov't Code Ann. § 22.221 (West 2004); see also Tex. R. App. P. 52. In the petition, relator asks this Court to compel the Honorable George Barnstone, presiding judge of the County Civil Court at Law No. 1 of Harris County, to sign an order authorizing a writ of possession to remove real party-in-interest Tara S. Jennings from her apartment during the pendency Jennings's appeal of the justice's court's judgment to the county court. Relator also filed a motion for emergency temporary relief asking our Court to grant the same relief requested in relator's petition.
On April 18, 2017, Tara Jennings filed a “Suggestion of Mootness” with our court arguing that this mandamus proceeding was moot because realtor had nonsuited the underlying suit. Our court sent the parties letter stating that the court will consider dismissal of this mandamus proceeding on its own motion unless any party files a response on or before May 8, 2017, showing meritorious grounds for continuing the mandamus proceeding. No such response has been filed.
Accordingly, we dismiss relator's petition for writ of mandamus.
