IN RE: CHRISTINE L. BLOW AND KEN A. BLOW, Relators
MEMORANDUM OPINION
Before the Court is relators' January 6, 2017 Petition for Writ of Injunction and/or Prohibition in which relators seek a stay of the enforcement of a writ of possession via eviction scheduled to occur at 8:00 a.m. on Monday, January 9, 2017. Under the Texas Property Code, a judgment in a forcible detainer suit “may not under any circumstances be stayed pending appeal unless, within 10 days of the signing of the judgment, the appellant files a supersedeas bond in an amount set by the county court.” TEX. PROP. CODE. § 24.007. Relators have not posted a supersedeas bond and more than ten days have passed since the judgment was signed. Accordingly, we deny the petition and we deny as moot relators' January 6, 2017 motion for temporary emergency relief.
