BRENT BRASHER TRIFOLD INTERNATIONAL v. TRIDENT REALTY INVESTMENTS LLC (2017)

MEMORANDUM OPINION

The filing fee, docketing statement, and the clerk's record in this case are overdue. By postcards dated November 17, 2016, we notified appellant that the filing fee and the docketing statement for this appeal had not been filed. We cautioned appellant that this case would be subject to dismissal without further notice if we did not receive the filing fee or the docketing statement within ten days. To date, the filing fee and docketing statement have not been filed.

By letter dated January 18, 2017, we informed appellant that we received notice from the county clerk that the clerk's record has not been filed because appellant had not paid or made arrangements to pay the clerk's fee. We directed appellant to provide verification of payment or arrangements to pay for the clerk's record or to provide written verification he is entitled to proceed without payment of costs. We cautioned appellant that we would dismiss this appeal if we did not receive the required documentation within ten days. To date, appellant has not paid the filing fee, filed a docketing statement, filed the requested verification or documentation, or otherwise corresponded with the Court regarding the status of this appeal.

Accordingly, we dismiss this appeal. See TEX. R. APP. P. 37.3(b); 42.3(b)(c).
