IN RE: EUGENE SHANNON ABNER, Relator
MEMORANDUM OPINION
On December 23, 2016, relator Eugene Shannon Abner filed a petition for writ of mandamus in this court. See Tex. Gov't Code Ann. § 22.221 (West 2004); see also Tex. R. App. P. 52. In the petition, relator asks this court to compel the Honorable Catherine Evans, presiding judge of the 180th District Court of Harris County, to compel the District Clerk to file certain documents as part of the record for an appeal that relator filed with this court, No. 14-16-00780-CV, Eugene Shannon Abner v. State of Texas (the appeal).
On January 10, 2017, we issued an opinion dismissing the appeal because it was not timely perfected. Accordingly, relator's petition for writ of mandamus related to the record for that appeal is now moot.
We therefore also dismiss relator's petition for writ of mandamus.
