MEMORANDUM OPINION
Appellant, Builders First Source-Texas Group, LP, perfected an appeal from a judgment entered by the 249th District Court of Johnson County, Texas, in cause number DC-C201500805.1 Appellant has filed an agreed voluntary dismissal motion on grounds that the parties have reached an agreement regarding the subject matter of this interlocutory appeal and the appellant no longer wishes to pursue the appeal. Appellant requests that this Court dismiss the appeal.
The Court, having considered the documents on file and appellant's agreed voluntary dismissal motion, is of the opinion that the motion should be granted. See TEX. R. APP. P. 42.1(a). Appellant's agreed voluntary dismissal motion is granted, and the appeal is hereby DISMISSED. In accordance with the agreement of the parties, costs are taxed against the party incurring same. See TEX. R. APP. P. 42.1(d). Having dismissed the appeal at the appellant's request, no motion for rehearing will be entertained, and our mandate will issue forthwith.
