HUGH TURNER APPELLANT v. NATIONAL JUDGMENT RECOVERY CENTER, L.P. AS ASSIGNEE OF UMTH LENDING COMPANY LP AND READY AMERICA FUNDING CORP.; AND JPMORGAN CHASE BANK, N.A. APPELLEES
MEMORANDUM OPINION 1 AND JUDGMENT
On August 30, 2016, after filing his brief, appellant Hugh Turner filed a “Notice to Dismiss Appeal.” In that document, he represented that he had reached a settlement with appellees. The document did not contain a certificate of service or a certificate of conference, so we asked appellant to submit a certificate of service and a certificate of conference by September 30, 2016. He did not do so. Nonetheless, counsel for appellees has informed this court that appellees do not oppose dismissal of the appeal. Therefore, in accordance with appellant's unopposed request, we dismiss this appeal. See Tex. R. App. P. 42.1(a)(1), 43.2(f); Eastman v. Willowick Apartments, 139 S.W.3d 348, 349 (Tex. App.—Fort Worth 2004, no pet.). Appellant shall pay the costs for the appeal, for which let execution issue. See Tex. R. App. P. 42.1(d).
