MEMORANDUM OPINION 1
After appellant filed his notice of appeal, the trial court granted his motion for new trial, to which the State agreed. After granting the motion for new trial, the trial court dismissed the underlying trial court case at the State's request. Because there is now no judgment of conviction or other appealable order for appellant to complain of, we grant appellant's motion to dismiss this appeal. See Tex.R.App. P. 21.9(b), 25.2(a)(2), 26.2(a), 43.2(f); Tex.Code Crim. Proc. Ann. art. 44.02 (West 2006).
