Opinion By Justice Francis

Hector Zuniga Martinez filed an application for writ of habeas corpus seeking to avoid extradition to Georgia where he is charged with the offenses of aggravated assault and murder. Following a hearing, the trial judge denied habeas corpus relief. The Court now has before it appellant's October 14, 2011 motion to dismiss the appeal. The motion is signed by appellant and counsel. See Tex.R.App. P. 42.2(a). Accordingly, we grant the motion and dismiss the appeal.
