MEMORANDUM OPINION
Opinion By Chief Justice Wright
By letter dated May 12, 2011, the Court notified appellant that the $175 filing fee was due and required appellant to pay the fee within ten days. The Court warned appellant that failure to pay the fee will result in dismissal of the case without further notice.
By letter dated May 12, 2011, the Court notified appellant that he had not filed a docketing statement in this appeal. We directed appellant to file a docketing statement within ten days. We warned appellant that if a docketing statement was not filed within ten days then the appeal may be dismissed.
As of the date of this order, appellant has not paid the filing fee and has not filed the docketing statement. Accordingly, we dismiss the appeal. See Tex.R.App. P. 42.3(c).
