MEMORANDUM OPINION
The Court has before it the parties' July 18, 2011 joint motion to lift abatement and set aside judgment pursuant to settlement and request for expedited relief. We have granted the motion to lift abatement by separate order. We GRANT the motion to set aside judgment, VACATE the probate court's Order Sustaining Motion Albert G. Hill, Jr.'s Motion for Summary Judgment Regarding Albert G. Hill III's Beneficiary Status without regard to the merits, and REMAND the case to the trial court for rendition of judgment in accordance with the parties' settlement agreement. See Tex.R.App. P. 42.1(a)(2).
