MEMORANDUM OPINION

The above appeal was abated on September 9, 2004 due to appellant's filing of bankruptcy.   In response to our inquiry regarding the status of the bankruptcy proceedings, we received correspondence from appellee's counsel stating the case was settled in the bankruptcy proceedings.   Appellant has not contradicted appellee's information.   Accordingly, we dismiss the appeal.   See Klein v. Hernandez, 315 S.W.3d 1, 3-4 (Tex.2010).
