XAVIER CHAPA, XCES, LLC, A TEXAS LIMITED LIABILITY COMPANY, AND XAVIER CHAPA ENGINEERING/SURVEYING, LTD., Appellants v. XC ENTERPRISES, INC., A TEXAS CORPORATION, AND JOEL HURLEY, Appellees
MEMORANDUM OPINION
On June 28, 2010, the Court abated this appeal upon the filing of appellant Xavier Chapa's suggestion of bankruptcy. By letter date December 10, 2010, the Court directed the parties to notify us of the status of the bankruptcy proceedings within ten days. We warned that if we did not receive a response, we would presume the bankruptcy proceedings had concluded and we would reinstate and dismiss the appeal. See Tex.R.App. P. 42.3(c). To date, we have not had any response to our December 10, 2010 letter. Accordingly, we dismiss the appeal.
