MEMORANDUM OPINION
This appeal was abated on April 23, 2004 due to the filing of bankruptcy by appellee. Since that date, the Court has had no communication from either party regarding the status of the bankruptcy proceedings. On October 20, 2010 and December 10, 2010, the Court sent the parties letters inquiring about the status of the bankruptcy proceedings. Our December 10, 2010 letter warned that if we did not receive a response within ten days, we would presume the bankruptcy proceedings had concluded and we would reinstate and dismiss the appeal. See generally Tex.R.App. P. 42.3(c). To date, neither party has responded. Accordingly, we dismiss the appeal.
