Appellant has filed a motion stating he no longer wishes to proceed with his appeal and asking the Court to dismiss it. See Tex.R.App. P. 42.1(a)(1). Appellee, who filed a cross-appeal, does not oppose the dismissal. See id. Accordingly, we GRANT the December 9, 2010 motion and dismiss the appeal and cross-appeal.
