MEMORANDUM OPINION

On July 15, 2009, the Court abated the appeal upon receiving notice appellant Deco-Dence, L.L.C. had filed bankruptcy.   Appellants did not respond to our June 10, 2010 letter inquiring about the status of the bankruptcy proceedings.   However, counsel for some of the appellees responded that they had not received notice the bankruptcy stay had been lifted to allow the appeal to proceed.

On September 15, 2010, we sent a second letter inquiring about the status of the bankruptcy proceedings.   We warned appellants that failure to respond would result in dismissal of the appeal without further notice.   See Tex.R.App. P. 42.3(c).  To date, appellants have not responded to our inquiry about the bankruptcy proceedings nor otherwise communicated with the Court regarding the appeal.

Accordingly, we dismiss the appeal.
