MEMORANDUM OPINION
On October 13, 2010, the Court ordered the Dallas County Clerk to file either the clerk's record or written verification that appellant has not paid for the record. We warned appellant that if we received verification of non-payment, we would, without further notice, dismiss the appeal. See Tex.R.App. P. 37.3(b). On October 25, 2010, we received correspondence from the Dallas County Clerk stating appellant has not paid for the record. Appellant has not provided the Court with proof he has paid for the record, nor has he otherwise communicated with the Court regarding the appeal. Accordingly, we dismiss the appeal.
