MEMORANDUM OPINION
This appeal was abated on October 24, 2005 due to the filing of bankruptcy by appellee George E. Rogers. See Tex.R.App. P. 8.2. By letter dated June 8, 2010, the Court directed the parties to notify us of the status of the bankruptcy proceedings. In response, appellant's counsel filed a letter stating the bankruptcy court entered an order discharging appellee George E. Rogers in the bankruptcy case and the issues in this appeal are now moot. Accordingly, we dismiss the appeal.
