MEMORANDUM OPINION

The above appeal was abated on October 8, 2002 pending disposition of the appeal in cause no. 05-00-01713-CV, styled James G. Crow, et al. v. Wellness International Network, Ltd. That appeal became final on February 25, 2004 when this Court issued its mandate. See Crow v. Int'l Network, Ltd., No. 05-00-01713-CV (Tex.App.-Dallas Aug. 21, 2002, pet. denied) (not designated for publication). Therefore, by letter dated June 4, 2010, we directed the parties to notify us why this appeal should not be reinstated and either be dismissed or set for submission. On June 11, 2010, we received correspondence from appellant's counsel stating that due to the resolution of Crow v. International Network, Ltd., appellant no longer desires to pursue the appeal in this case. We will treat the June 11, 2010 letter as a motion to dismiss the appeal.

We grant the motion and dismiss the appeal. See Tex.R.App. P. 42.1(a).
