MEMORANDUM OPINION
On October 16, 2009, this Court granted appellant a thirty-day extension of time to file his brief. When the brief was not filed by January 4, 2010, we sent appellant a letter directing him to file his brief and an extension motion within ten days. We warned that failure to comply would result in dismissal of the appeal. See Tex.R.App. P. 38.8(a), 42.3. To date, appellant has neither filed his brief nor otherwise communicated with the Court regarding his appeal. Accordingly, we dismiss the appeal for want of prosecution. See Tex.R.App. P. 38.8(a), 42.3(b).
