RANDALL BYARS, Appellant v. DB STRUCTURED PRODUCTS, INC., LONG BEACH MORTGAGE, SELECT PORTFOLIO SERVICING, INC., AND WASHINGTON MUTUAL BANK, Appellees
MEMORANDUM OPINION
By order dated October 5, 2009, the Court ordered appellant to file his brief within thirty days. When the brief was not received by November 13, 2009, we sent appellant a letter directing him to file his brief and an extension motion within ten days. We warned appellant that failure to comply would result in dismissal of the appeal. See Tex.R.App. P. 38.8(a), 42.3. To date, appellant has neither filed his brief nor otherwise communicated with the Court regarding the appeal. Accordingly, we dismiss the appeal for want of prosecution. See Tex.R.App. P. 38.8(a), 42.3(b).
