MEMORANDUM OPINION
The Court has before it the parties' January 26, 2010 joint motion to dismiss this appeal. In their motion, the parties advise us they have reached an agreement to settle and compromise and ask the Court to set aside the trial court's judgment and remand to the trial court for rendition of judgment in accordance with the parties' agreement.
We grant the joint motion, set aside the trial court's judgment without regard to the merits, dismiss this appeal, and remand to the trial court for rendition of judgment in accordance with the parties' agreement. See Tex.R.App. P. 42.1(a)(2).
