ASSOCIATED PRESS et al. v. Kenneth NELSEN et al.
ORDER
On March 11, 2026, Kenneth Nelsen, in his official capacity as Warden of Riverbend Maximum Security Institution, and Frank Strada, in his official capacity as Commissioner of the Tennessee Department of Correction, filed an application for extraordinary appeal seeking review of the trial court's January 16, 2026 order granting a temporary injunction. Appellants also filed a motion for stay pending appeal.
On March 17, 2026, this Court ordered Appellees to file an answer to the application, which was timely filed on March 27, 2026. Appellees also filed an opposition to Appellants’ motion for stay pending appeal.
Upon due consideration, the application for extraordinary appeal is GRANTED. The trial court clerk shall file the record on appeal within thirty days of the date of this order. Tenn. R. App. P. 10(d). Briefing shall proceed in accordance with Tenn. R. App. P. 29. The Clerk is directed to place this matter on the docket for oral argument upon the completion of briefing.
The motion for stay pending appeal also is GRANTED. The trial court's January 16, 2026 order granting a temporary injunction is stayed pending further order of this Court.
