Maurice Oparaji, Plaintiff-Appellant, v. Turkish Airlines, Inc., Defendant-Respondent.
Per Curiam.
Appeal from order (Allison R. Greenfield, J.), entered June 4, 2026, dismissed, without costs, for failure to perfect the appeal in accordance with the CPLR and the rules of this Court.
The appendix submitted on this appeal from the denial of plaintiff's motion to restore this case to the trial calendar is patently insufficient for the purpose of reviewing the contentions raised in the parties' briefs, since plaintiff failed to submit, among other things, the papers underlying his motion, including defendant's opposition to the motion and the Civil Court's January 8, 2026 order, denying plaintiff's prior motion for the same relief (see Davis v Prestige Mgt. Inc., 167 AD3d 470 [2018]; Kenan v Levine & Bilt, PLLC, 136 AD3d 554, 555 [2016]).
We also note that as a result of our prior order (see Oparaji v Turkish Airlines, Inc., 87 Misc 3d 127[A], 2025 NY Slip Op 51471[U] [App Term, 1st Dept 2025]), all claims have been adjudicated and nothing remains to be tried.
All concur.
THIS CONSTITUTES THE DECISION AND ORDER OF THE COURT.
