RE: AMENDMENTS TO RULE 422 AND APPENDIX G TO PART IV, SOUTH CAROLINA APPELLATE COURT RULES
ORDER
Pursuant to the provisions of Article V, Section 4 of the South Carolina Constitution, Rule 422, SCACR, and Appendix G to Part IV, SCACR, are amended as set forth in the attachment to this order.
The amendments to Rule 422, SCACR, increase the number of at-large members of the Commission on Alternative Dispute Resolution (ADR Commission) from three to eight members. The amendments to Appendix G increase the number of ADR Commission members to constitute a quorum and clarify that the terms for at-large members are the same as for other members appointed by the Supreme Court.
These amendments are effective immediately.

Attachment
Rule 422(b)(8), SCACR, is amended to provide:
(b) Membership of Commission. The Commission's Chair will be the Chief Justice or the Chief Justice's designee. The Supreme Court will appoint the Commission's other members as follows:

(8) Eight at-large members who may be certified mediators or arbitrators or who are otherwise involved in alternative dispute resolution.
Section II(A) of Appendix G to Part IV, SCACR, is amended to provide:
II. MEMBERSHIP
A. The membership is defined in Rule 422. Members appointed under sections (b)(1) - (4) and (b)(8) of Rule 422 will serve for a term of three years provided, however, that initial appointments and subsequent appointments may be for terms less than three years to accomplish staggered terms.
Section IV(B) of Appendix G to Part IV, SCACR, is amended to provide

B. At all meetings twelve members will constitute a quorum. The latest edition of Robert's Rules of Order will govern proceedings.
