The PEOPLE, etc., respondent, v. Gregory TIETJE, appellant.
DECISION & ORDER
Appeal by the defendant from a judgment of the County Court, Dutchess County (Jessica Z. Segal, J.), rendered October 31, 2024, convicting him of operating a motor vehicle while under the influence of alcohol, upon his plea of guilty, and imposing sentence.
ORDERED that the judgment is affirmed.
The defendant appeals from a judgment convicting him, upon his plea of guilty, of operating a motor vehicle while under the influence of alcohol.
The defendant's contention that the County Court failed to specify the duration of the ignition interlock device condition of his conditional discharge is unpreserved for appellate review (see CPL 470.05[2]; see also People v. Dancy, 206 AD3d 823, 824) and, in any event, without merit.
The defendant's contention challenging the surcharge imposed is unpreserved for appellate review (see CPL 470.05[2]; People v. Zolorsano, 233 AD3d 901, 902; People v. Smith, 57 AD3d 1410, 1411) and, in any event, without merit (see Penal Law § 60.35[1][a][i], [v]; Vehicle and Traffic Law §§ 1809–c[1]; 1809–e[1][b] ).
The defendant's remaining contention is academic.
DILLON, J.P., BRATHWAITE NELSON, WOOTEN and LANDICINO, JJ., concur.
