DECISION & ORDER
Appeal by the defendant, as limited by his motion, from a resentence of the Supreme Court, Queens County (Gia Lynne Morris, J.), imposed January 22, 2026, upon the granting of his motion pursuant to CPL 440.20 to set aside a sentence of the same court (Barry Schwartz, J.) imposed December 6, 2018, upon his convictions of assault in the first degree and robbery in the second degree, upon a jury verdict, on the ground that the resentence was excessive.
ORDERED that the resentence is affirmed.
The resentence imposed was not excessive (see People v. Suitte, 90 A.D.2d 80, 455 N.Y.S.2d 675).
CONNOLLY, J.P., CHRISTOPHER, VOUTSINAS, LOVE and GOLDBERG VELAZQUEZ, JJ., concur.
