DECISION & ORDER
In an action to foreclose a mortgage, the plaintiff appeals from an order of the Supreme Court, Queens County (Tracy Catapano–Fox, J.), entered September 26, 2022. The order, insofar as appealed from, granted that branch of the motion of the defendants Mahmuda Ahmed and Mohammed Sagir Ahmed which was for summary judgment dismissing the complaint insofar as asserted against them on the ground that the plaintiff failed to comply with RPAPL 1304.
ORDERED that the appeal is dismissed as academic, without costs or disbursements.
The appeal must be dismissed as academic in light of our determination on a related appeal (see U.S. Bank N.A. v Ahmed, [Appellate Division Docket No. 2023–09510, ––– AD3d ––––, 2026 WL 2249475; decided herewith] ).
