IN RE: Andrew G. Maloney, FOR REINSTATEMENT admitted as Andrew Gerald Eardley Maloney, a disbarred attorney. (Attorney Registration No. 2242915) Motion by Andrew G. Maloney for reinstatement to the Bar as an attorney and counselor-at-law. Mr. Maloney was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on February 8, 1989, under the name Andrew Gerald Eardley Maloney. By decision and order on motion of this Court dated December 27, 1999, the matter was referred to the Honorable Jerome M. Becker, as Special Referee to hear and report. By opinion and order of this Court dated April 16, 2001, Mr. Maloney was disbarred based on the Special Referee's report which sustained multiple charges of professional misconduct (see Matter of Maloney, 282 A.D.2d 112). By decision and order on motion of this Court dated August 7, 2001, Mr. Maloney's motion for leave to reargue the opinion and order dated April 16, 2001, was denied. On October 16, 2002, Mr. Maloney's petition for writ of certiorari to the U.S. Supreme Court was denied. By decision and order on motion of this Court dated June 25, 2010, Mr. Maloney's motion for reinstatement was held in abeyance and the matter was referred to the Committee on Character and Fitness to hear and report on Mr. Maloney's current fitness to be an attorney. Upon the papers filed in support of the motion and the papers filed in relation thereto, and upon the report of the Committee on Character and Fitness and the exhibits annexed thereto, it is ORDERED that the motion is granted; and it is further, ORDERED that, effective immediately, Andrew Gerald Eardley Maloney is reinstated as an attorney and counselor-at-law and the Clerk of the Court is directed to restore the name of Andrew Gerald Eardley Maloney to the roll of attorneys and counselors-at-law.
