IN RE: Andrew McGee, admitted as Andrew Briscoe McGee, an attorney and counselor-at-law. Grievance Committee for the Second, Eleventh, and Thirteenth Judicial Districts, petitioner; Andrew McGee, respondent. (Attorney Registration No. 1020007) Motion by the Grievance Committee for the Second, Eleventh, and Thirteenth Judicial Districts to recall and vacate this Court's decision and order on motion dated March 30, 2010, which authorized it to institute and prosecute a disciplinary proceeding against the respondent based upon two alcohol-related misdemeanor convictions, and referred the issues raised to the Honorable Harry E. Seidell, as Special Referee to hear and report, and, in lieu thereof, to strike the respondent's name from the roll of attorneys and counselors-at-law, pursuant to Judiciary Law § 90(4), based upon his felony conviction. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on May 5, 1976, under the name Andrew Briscoe McGee. Upon the papers submitted to the Court, it is ORDERED that the motion is granted, the decision and order on motion of this Court dated March 30, 2010, is recalled and vacated, and the following opinion and order is substituted therefor: Motion by the Grievance Committee for the Second, Eleventh, and Thirteenth Judicial Districts for an order striking the respondent's name from the roll of attorneys and counselors-at-law, pursuant to Judiciary Law § 90(4)(b), on the ground that he has been automatically disbarred by virtue of a felony conviction. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on May 5, 1976, under the name Andrew Briscoe McGee. DECISION & ORDER ON MOTION
On March 19, 2010, the respondent pleaded guilty in the Supreme Court, Richmond County, before the Honorable Leonard P. Rienzi, to driving while intoxicated in violation of Vehicle and Traffic Law § 1192.3. Pursuant to Vehicle and Traffic Law § 1193(1)(c)(ii), that offense constitutes a class D felony in view of his two prior convictions.
The respondent was sentenced on May 26, 2010, to a period of six months of incarceration, and his driver's license was revoked for a period of five years based on the felony conviction.
By virtue of his felony conviction on March 19, 2010, the respondent was automatically disbarred pursuant to Judiciary Law § 90(4)(a), and ceased to be an attorney by operation of law.
Accordingly, the Grievance Committee's motion to strike the respondent's name from the roll of attorneys and counselors-at-law is granted to reflect the respondent's automatic disbarment as of March 19, 2010, the date of his felony conviction.
PRUDENTI, P.J., RIVERA, SKELOS, DILLON and CHAMBERS, JJ., concur.
ORDERED that pursuant to Judiciary Law § 90(4)(a), the respondent, Andrew McGee, admitted as Andrew Briscoe McGee, is disbarred, effective March 19, 2010, and his name is now stricken from the roll of attorneys and counselors-at-law, pursuant to Judiciary Law § 90(4)(b); and it is further,
ORDERED that the respondent, Andrew McGee, admitted as Andrew Briscoe McGee, shall comply with this Court's rules governing the conduct of disbarred, suspended, and resigned attorneys (see 22 NYCRR 691.10); and it is further,
ORDERED that pursuant to Judiciary Law § 90, the respondent, Andrew McGee, admitted as Andrew Briscoe McGee, is commanded to desist and refrain from (l) practicing law in any form, either as principal or as agent, clerk, or employee of another, (2) appearing as an attorney or counselor-at-law before any court, Judge, Justice, board, commission, or other public authority, (3) giving to another an opinion as to the law or its application or any advice in relation thereto, and (4) holding himself out in any way as an attorney and counselor-at-law; and it is further,
ORDERED that if the respondent, Andrew McGee, admitted as Andrew Briscoe McGee, has been issued a secure pass by the Office of Court Administration, it shall be returned forthwith to the issuing agency and the respondent shall certify to the same in his affidavit of compliance pursuant to 22 NYCRR 691.10(f).
