DECISION & ORDER
Appeal by the defendant from a judgment of the County Court, Rockland County (Anne B. Bianchi, J.), rendered June 11, 2024, convicting him of sexual abuse in the first degree, upon his plea of guilty, and imposing sentence.
ORDERED that the judgment is affirmed.
Contrary to the People's contention, the defendant's purported waiver of his right to appeal was invalid (see People v. Roseborough, ––– A.D.3d ––––, 242 N.Y.S.3d 108; People v. Johnson, 241 A.D.3d 706, 238 N.Y.S.3d 300). However, the sentence imposed was not excessive (see People v. Suitte, 90 A.D.2d 80, 455 N.Y.S.2d 675).
