DECISION & ORDER
In an action, inter alia, to recover damages for battery, the defendant appeals from an extract of the clerk's minutes of trial dated June 18, 2021.
ORDERED that the appeal is dismissed, with costs, as no appeal lies from an extract of clerk's minutes of trial (see Promenade Nursing Home, Inc. v. City of New York, 191 A.D.3d 1025, 1025, 143 N.Y.S.3d 366; Rodriguez v. Virga, 24 A.D.3d 650, 650, 808 N.Y.S.2d 373).
