The PEOPLE, etc., respondent, v. Barry ELMORE, appellant.
Appeal by the defendant from a judgment of the Supreme Court, Queens County (Lewis, J.), rendered September 14, 2005, convicting him of grand larceny in the fourth degree, criminal mischief in the fourth degree, possession of burglar's tools, and jostling, upon a jury verdict, and imposing sentence.
ORDERED that the judgment is affirmed.
The defendant's contention that the evidence was legally insufficient to establish that he acted in concert with his codefendants is without merit. Viewing the evidence in the light most favorable to the prosecution (see People v. Contes, 60 N.Y.2d 620, 467 N.Y.S.2d 349, 454 N.E.2d 932), there existed a “valid line of reasoning and permissible inferences [which] could lead a rational person to the conclusion reached by the fact finder on the basis of the evidence at trial” (People v. Hines, 97 N.Y.2d 56, 62, 736 N.Y.S.2d 643, 762 N.E.2d 329; see People v. Coulter, 240 A.D.2d 756, 660 N.Y.S.2d 43; People v. Roldan, 211 A.D.2d 366, 627 N.Y.S.2d 1014, affd. 88 N.Y.2d 826, 643 N.Y.S.2d 960, 666 N.E.2d 553; People v. Slack, 163 A.D.2d 130, 130-131, 557 N.Y.S.2d 355). Moreover, upon the exercise of our factual review power (see CPL 470.15[5] ), we find that the verdict of guilt was not against the weight of the evidence (see People v. Romero, 7 N.Y.3d 633, 826 N.Y.S.2d 163, 859 N.E.2d 902).
The defendant's contention that he was denied the effective assistance of counsel is without merit. A review of the circumstances in totality reveals that the defendant was afforded meaningful representation (see People v. Henry, 95 N.Y.2d 563, 565, 721 N.Y.S.2d 577, 744 N.E.2d 112; People v. Baldi, 54 N.Y.2d 137, 147, 444 N.Y.S.2d 893, 429 N.E.2d 400; People v. Daniels, 35 A.D.3d 495, 496, 826 N.Y.S.2d 369; People v. Hill, 163 A.D.2d 813, 814, 558 N.Y.S.2d 345; People v. Blanco, 162 A.D.2d 540, 543, 556 N.Y.S.2d 735). Contrary to the defendant's argument, defense counsel sought, albeit unsuccessfully, to exclude from evidence the razor that was recovered from the defendant at the time of his arrest, three days after the alleged crime, as inadmissible evidence of an uncharged crime pursuant to People v. Ventimiglia, 52 N.Y.2d 350, 438 N.Y.S.2d 261, 420 N.E.2d 59. Contrary to the defendant's further contention, the failure to make a meritless suppression motion pursuant to Mapp v. Ohio, 367 U.S. 643, 81 S.Ct. 1684, 6 L.Ed.2d 1081 does not constitute the ineffective assistance of counsel (see People v. Caban, 5 N.Y.3d 143, 152-153, 800 N.Y.S.2d 70, 833 N.E.2d 213; People v. Daniels, 35 A.D.3d 495, 496, 826 N.Y.S.2d 369). Since the property in question was recovered from the defendant when he was arrested for a separate crime, as to which the defendant pleaded guilty, a motion to suppress the physical evidence on the ground that the defendant had been arrested at that time without probable cause would have been unsuccessful (see People v. Rivera, 71 N.Y.2d 705, 709, 530 N.Y.S.2d 52, 525 N.E.2d 698).
