PEOPLE of the State of New York, Plaintiff-Respondent, v. David L. HOGAN, Defendant-Appellant.
Contrary to the contention of defendant, the verdict is supported by legally sufficient evidence and is not contrary to the weight of the evidence (see, People v. Bleakley, 69 N.Y.2d 490, 495, 515 N.Y.S.2d 761, 508 N.E.2d 672). The sentence is neither unduly harsh nor severe. Defendant freely bargained for the maximum sentence upon his conviction of criminal possession of a weapon in the second degree in satisfaction of pending charges of, inter alia, assault in the first degree and criminal possession of a controlled substance in the third degree (see, People v. Kohler, 147 A.D.2d 937, 538 N.Y.S.2d 735, lv. denied 73 N.Y.2d 1017, 541 N.Y.S.2d 772, 539 N.E.2d 600; see also, People v. Cotton, 219 A.D.2d 836, 837, 632 N.Y.S.2d 35, lv. denied 87 N.Y.2d 900, 641 N.Y.S.2d 229, 663 N.E.2d 1259).
Judgment unanimously affirmed.
