Order, Supreme Court, Bronx County (Patricia Anne Williams, J.), entered on or about March 22, 2007, which, insofar as appealed from, granted defendant's motion to dismiss the complaint, unanimously affirmed, with costs.
Defendant's promise to pay plaintiff money at the end of their cohabitation relationship is unenforceable because the main consideration therefor, under the parties' cohabitation agreement, was plaintiff's provision of “companionship (both platonic and sexual)” (see Morone v. Morone, 50 N.Y.2d 481, 486, 429 N.Y.S.2d 592, 413 N.E.2d 1154 [1980]; McRay v. Citrin, 270 A.D.2d 191, 706 N.Y.S.2d 27 [2000] ). Furthermore, the agreement, which was executed prior to plaintiff's divorce, facilitated adultery (see Dulko v. Reich, 276 A.D.2d 521, 714 N.Y.S.2d 691 [2000] ). Plaintiff's causes of action for fraud, unjust enrichment, imposition of a constructive trust and intentional infliction of emotional distress are based on the promises contained in the agreement and therefore cannot be maintained (see Jennings v. Hurt, 160 A.D.2d 576, 554 N.Y.S.2d 220 [1990], lv. denied 77 N.Y.2d 804, 568 N.Y.S.2d 347, 569 N.E.2d 1026 [1991]; cf. Artache v. Goldin, 133 A.D.2d 596, 600, 519 N.Y.S.2d 702 [1987] ). We have considered plaintiff's other arguments and find them unavailing.
