Appeal, insofar as taken from that part of the Appellate Division order that affirmed so much of the Supreme Court order granting the motion to quash the subpoenas and denying as premature the cross-motion to permit alternate service of the subpoenas, dismissed without costs, by the Courtsua sponte, upon the ground that such portion of the order appealed from does not finally determine the action within the meaning of the Constitution.
Judge Halligan took no part.
