ORDER DENYING PETITION FOR WRIT OF MANDAMUS
This original petition for a writ of mandamus challenges a district court discovery order adopting a discovery commissioner's recommendation.
“A writ of mandamus is available to compel the performance of an act that the law requires ․ or to control an arbitrary or capricious exercise of discretion.” Int'l Game Tech., Inc. v. Second Jud. Dist. Ct., 124 Nev. 193, 197, 179 P.3d 556, 558 (2008); see NRS 34.160. Having reviewed the petition, answer to the petition, and reply, we decline to exercise our discretion to entertain the petition. See City of Mesquite v. Eighth Judicial Dist. Court, 135 Nev. 240, 242, 445 P.3d 1244, 1248 (2019) (entertaining a writ petition is within the court's discretion).
Petitioners have not met their burden to demonstrate that extraordinary relief is warranted. Pan v. Eighth Jud. Dist. Ct., 120 Nev. 222, 228, 88 P.3d 840, 844 (2004). Specifically, we are not persuaded that an appeal following a final judgment would be an inadequate remedy. Id. at 224, 88 P.3d at 841. Accordingly, we
ORDER the petition DENIED.1
