ANTHONY PETTY, Appellant, v. THE STATE OF NEVADA, Respondent.
ORDER DISMISSING APPEAL
This appeal was initiated by the filing of a pro se notice of appeal. Eighth Judicial District Court, Clark County; Michelle Leavitt, Judge.
This court's review of the notice of appeal reveals a jurisdictional defect. Specifically, the notice of appeal identifies Jack of response to petition for writ of mandamus prohibition” as the order being challenged on appeal. However, the failure to file a response is not an appealable order, and no order to which the notice of appeal could apply appears on the docket. Indeed, it appears that appellant's petition has been pending since July 2024, with no order entered in the case except for an order statistically closing case in December 2025. Thus, while this court lacks jurisdiction over this appeal, see Castillo v. Slate, 106 Nev. 349, 352, 792 P.2d 1133, 1135 (1990) (explaining that this court has jurisdiction only when statute or court rule provides for appeal), we expect that the district court will promptly review the matter to determine whether further action below is required. We thus
ORDER this appeal DISMISSED.
