ORDER DISMISSING APPEAL
This is an appeal of an order denying a petition for judicial review. Eighth Judicial District Court, Clark County; Jennifer L. Schwartz, Judge.
Respondent has filed a motion to dismiss the appeal as untimely. Appellant opposes the motion. Respondent argues that the appeal was untimely filed because it was filed 33 days after written notice of entry of the challenged order was served. See NRAP 4(a)(1) (requiring the notice of appeal be filed within 30 days of service of written notice of entry of the order challenged on appeal). Appellant attributes the late filing to a clerical error and argues the appeal should be heard on its merits.
Written notice of entry of the order challenged in this appea was served electronically on appellant's counsel on October 15, 2025. Therefore, the notice of appeal was due to be filed on or before November 14, 2025. See id. Appellant's counsel did not file the notice of appeal until November 17, 2025, three days beyond the deadline. This court “may not extend the time to file a notice of appeal except as provided in Rule 4(c).” NRAP 26(b)(1)(A). Rule 4(c) pertains to the untimely filing of a notice of appeal from a judgment of conviction and does not apply here. This court lacks jurisdiction to consider an untimely appeal. See Healy v. Volksivagenwerk Akliengesellschaft, 103 Nev. 329, 331, 741 P.2d 432, 433 (1987). Respondent's motion to dismiss is granted and we
