KIN YAN CHEUNG, Appellant, v. TOLL SOUTH LV LLC; AND WESTMINSTER TITLE AGENCY, INC., Respondents.
ORDER DISMISSING APPEAL
This is a pro se appeal from a district court order compelling arbitration. Eighth Judicial District Court, Clark County; Hon. Mark R. Denton, Judge.
Respondents have filed a motion to dismiss this appeal, arguing the challenged order is not substantively appealable.1 “[T]his court's appellate jurisdiction is limited ․ and we may only consider appeals authorized by statute or court rule.” Brown v. MHC Stagecoach, LLC, 129 Nev. 343, 345, 301 P.3d 850, 851 (2013) (internal citation omitted). Having considered the motion and documents before us, we conclude this court lacks jurisdiction over this appeal. An order compelling arbitration is not appealable. Kindred v. Second Jud. Dist. Ct., 116 Nev. 405, 409, 996 P.2d 903, 906 (2000); Tallman v. Eighth Jud. Dist. Ct., 131 Nev. 713, 718, 359 P.3d 113, 117 (2015) (“If at the very threshold of the proceeding the defaulting party could appeal and thereby indefinitely delay the matter of arbitration, the object of the law favoring arbitration and the purpose of the written agreement of the parties would be entirely defeated.” (citation modified)). Accordingly, respondents’ motion to dismiss is granted and this appeal is dismissed.
It is so ORDERED.
Stiglich, J.
Cadish, J.
Lee, J.
FOOTNOTES
1. Respondents additionally argued appellant's notice of appeal was untimely. Respondents subsequently filed a notice clarifying that they seek dismissal only on the ground that the challenged order is not substantively appealable.
