THE STATE OF NEVADA, Appellant, v. EDITH M. VICKERS, Respondent.
ORDER DISMISSING APPEAL
This is an appeal from a district court order denying a “motion for leave to file a felony information by affidavit pursuant to NRCrP Rule 4(3) and NRS 173.035(2).” Sixth Judicial District Court, Humboldt County; Hon. Michael Montero, Judge.
On August 4, 2026, this court directed appellant's counsel to show cause as to why this appeal should not be dismissed for lack of jurisdiction as no court rule or statute appeared to authorize appeal of the challenged order. Appellant's response to the order to show cause was due on September 1, 2026. On September 18, 2026, appellant filed an untimely motion for an extension of time to file a response to this court's August 4 order. According to appellant, additional time is needed due to a shortage of attorneys in counsel's office. No further information was offered justifying the extension or the untimeliness of the extension request. Respondent opposes the extension, arguing appellant has failed to demonstrate good cause justifying the extension or the untimely request and failed to comply with the requirements of NRAP 27(a)(2). This court agrees. Appellant's motion for an extension of time is denied. NRAP 26(b)(1)(A); NRAP 27(a)(2)(A), (B) (setting forth the minimum requirements for a motion requesting relief from this court).
“[T]he burden rests squarely upon the shoulders of a party seeking to invoke our jurisdiction to establish, to our satisfaction, that this court does in fact have jurisdiction.” Moran v. Bonneville Square Assocs., 117 Nev. 525, 527, 25 P.3d 898, 899 (2001). Here, in addition to its failure to demonstrate good cause justifying the untimeliness of the motion for extension and the extension itself, appellant has failed to demonstrate this court's jurisdiction over the challenged order. Accordingly, we conclude that we lack jurisdiction to consider this appeal and
